Motorcycle Accidents
The operation of a motorcycle can be a thrilling
and exhilarating experience. However, the operation of a motorcycle
presents special challenges and dangers to the operator and any passenger.
In most Wisconsin motorcycle accidents, the rider is severely injured
or killed, due to the lack of protection that a bike offers to the biker.
Unfortunately, operators of automobiles and other motor vehicles do not
always give the same respect to motorcycle operators as they do to fellow
motorists, even though the rules or the road apply equally to all motorists.
Many accidents occur when operators of cars, SUV’s and trucks make left
turns in front of motorcycles at intersections, or sideswipe a motorcycle
when changing lanes because they fail to maintain a proper lookout.
Common injuries resulting from motorcycle accidents include:
- Road rash
- Fractures
- Spinal cord injuries
- Death
- Head injuries/concussions causing lack or loss of memory
- Facial and body disfigurement
The other major injury that most bikers encounter is a traumatic brain
injury (TBI). Under Wisconsin law, duly licensed adult
operators of motorcycles are not required to wear helmets or
other protective headgear. See Wis. Stat. § 347.485. Protective headgear is only required
to be worn by those having an instructional permit, or any
operator or rider under 18 years of age. Id. This law
contributes to the number of head injuries following motorcycle
accidents, because many adult operators choose to not wear any
protective headgear.
Even if a helmet is worn, the biker’s head and body is exposed to serious injury. TBI is often caused by not wearing a helmet, but can even result when a helmet is
worn, given the forces involved in some crashes. Any time a motorcycle collides
with a vehicle or object, or the biker is thrown off of the motorcycle following
an impact, there is a chance of damage to the brain ranging from mild concussion
to total loss of brain functions leading to a persistent vegetative state.
Motorcycle accident claims can be complicated and difficult to pursue without help
and representation by experienced and competent legal counsel. When motorcycle
accidents occur resulting in serious personal injuries, the result is often thousands
of dollars in medical bills, substantial lost wages, and painful and lengthy rehabilitation.
When you or a loved one is injured or killed as a result of a motorcycle accident, you
need to hire an experienced and skilled motorcycle accident attorney who understand the
laws and knows how to successfully prosecute your case. The attorneys at Cannon &
