Economic vs. Non-Economic Damages

The legal processes following an injury caused by negligence can be confusing and leave the victim in a strange position. Unfortunately, there are a number of factors involved and they can keep you wondering what is going to happen next. One potential confusion that a victim may run into is the difference between economic and non-economic damages. This is an important part of the personal injury lawsuit that the victim should know to better understand what they may be entitled to by holding the responsible party accountable.

Economic Damages

When an injury victim is awarded economic damages, it is referring to the damages with monetary value that were lost as a result of the incident. This can include medical expenses due to the injury, costs associated with property damage, lost wages due to the victim being unable to work, and other monetary losses. These are the most common damages awarded to the victim in a personal injury case.

Non-Economic Damages

The term “non-economic damages” refers to factors that do not have a direct monetary value, but they are still considered damages. Examples of non-economic damages often include pain and suffering from the injury, emotional damage due to potential trauma, and loss of enjoyment of life. These are items that cannot be measured by a numerical figure, thus they are not considered economic. These damages often have limits placed on them regarding how much can be awarded to the injury victim.

In some situations, there may be another type of damages awarded called punitive damages. These are common in cases where the responsible party had intent to cause harm or showed wonton disregard for the action that led to the injury. Punitive damages are often awarded at the discretion of the court based on the evidence of the case.
